Terms and Conditions of Service

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Scrub-BaDub, Inc. (“Company,” “we,” “our,” or “us”) and any individual or entity (“User,” “you,” or “your”) who accesses, registers, or uses the Scrub-BaDub platform, mobile application, or website (collectively, the “Platform”).

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree, you must immediately discontinue use of the Platform.

1. Definitions

For the purposes of these Terms:

  • “Buds” shall mean customers who use the Platform to request laundry services.

  • “Scrubs” shall mean independent service providers who wash, dry, and fold laundry.

  • “Dubers” shall mean independent contractors who perform pickup and delivery services.

  • “Order” shall mean a confirmed request by a Bud for laundry services via the Platform.

  • “Services” shall mean the pickup, cleaning, folding, and delivery of laundry as facilitated by the Platform.

2. Scope of Services

2.1 The Company operates solely as a technology intermediary, providing an online marketplace that connects Buds with Scrubs and Dubers.

2.2 The Company does not:

  • Own or operate any laundry facilities, vehicles, or equipment;

  • Employ or directly supervise Scrubs or Dubers;

  • Provide laundry or delivery services directly.

2.3 Scrubs and Dubers are independent contractors and not employees, agents, or representatives of the Company.

3. Eligibility

3.1 You must be at least eighteen (18) years of age to create an account and use the Platform.

3.2 By registering, you represent and warrant that:

  • You are legally capable of entering into binding agreements;

  • The information you provide is true, accurate, and complete;

  • You will not use the Platform for unlawful, fraudulent, or abusive purposes.

4. User Accounts

4.1 Users must maintain the confidentiality of their account credentials and are solely responsible for all activities conducted under their account.

4.2 The Company reserves the right to suspend or terminate accounts for:

  • Misrepresentation;

  • Unauthorized use;

  • Violation of these Terms;

  • Engagement in conduct detrimental to the Platform or other Users.

5. Payments and Fees

5.1 Buds:

  • Buds agree to pay all fees displayed at the time of order confirmation, including but not limited to service fees, delivery charges, and applicable taxes.

  • Payments are processed exclusively through authorized third-party payment processors.

5.2 Scrubs and Dubers:

  • Compensation is disbursed through the Company’s payment processor after completion of services.

  • The Company deducts a platform service fee prior to disbursement.

Scrubs and Dubers are solely responsible for all applicable taxes and insurance obligations.

6. Cancellations and Refunds

6.1 A Bud may cancel an Order only until a Duber has confirmed pickup. Once pickup has occurred, all sales are final and non-refundable.

6.2 If a Scrub or Duber cancels an assignment, the Company may reassign the Order at no additional cost to the Bud.

6.3 Refunds, if issued, shall be at the sole discretion of the Company and may be granted in the form of account credits only.

7. Liability for Lost or Damaged Items

7.1 The Company shall not be liable for:

  • Items lost due to Bud’s failure to remove valuables from pockets;

  • Damage caused by manufacturer defects, mislabeled care instructions, or inappropriate service requests (e.g., “wash” requested for “dry-clean only” garments).

7.2 The maximum aggregate liability of the Company for any Order shall not exceed fifty U.S. dollars ($50), regardless of the nature of the claim.

7.3 Compensation shall be issued as platform credits only, not as cash reimbursement.

8. Responsibilities of Users

8.1 Buds shall:

  • Provide accurate pickup and delivery details;

  • Remove all valuables from clothing;

  • Separate delicate items requiring special treatment.

8.2 Scrubs shall:

  • Maintain sanitary, safe, and lawful facilities;

  • Adhere to generally accepted laundry practices;

  • Exercise reasonable care in handling garments.

8.3 Dubers shall:

  • Comply with all traffic and transportation laws;

  • Ensure timely and secure delivery of garments;

Maintain professional conduct while interacting with Buds.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, affiliates, and licensors from and against all claims, damages, losses, liabilities, and expenses arising out of or related to:

  • Your use of the Platform;

  • Your violation of these Terms;

  • Your interaction with Scrubs or Dubers.

10. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • Indirect, incidental, special, or consequential damages;

  • Lost profits, revenue, or data;

Any conduct of Scrubs, Dubers, or other Users of the Platform.

11. Dispute Resolution

11.1 Any dispute shall first be attempted to be resolved through the Company’s customer support.

11.2 If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA).

11.3 Users hereby waive the right to participate in class action lawsuits or class-wide arbitration.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

13. Amendments

The Company reserves the right to modify these Terms at any time. Users will be notified of material changes, and continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

14. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the parties and supersede all prior agreements, understandings, or representations.
